Terms of Use

These terms are an agreement between you and Pookie (“we”) covering the PookieiOS app, pookie.pics, and the passes we issue to Apple Wallet (together, the “Service”). By signing in or using the Service you accept them. Our Privacy Policy explains how we handle your data and is part of these terms.

1. Who can use Pookie

You need an Apple ID and must be at least 13 years old (or the minimum age to hold an Apple ID where you live). If you’re under 18 you need a parent or guardian’s permission. You’re responsible for everything done through your account.

2. What the Service does

Pookie lets you take a photo with a virtual instant camera, develop it, and add it to Apple Wallet as a pass. If you turn on the Location or Date options, the pass carries that photo’s location or date so Wallet can surface it later. Passes are delivered and displayed by Apple Wallet, which we don’t control; Wallet’s behavior (including how and when it surfaces passes) may change with iOS.

3. Your photos

  • You keep all rights to your photos.
  • You give us a limited license to store, process and deliver each photo you add to Wallet or give away, solely to provide the Service (build the pass, refresh it, void it when given away, and deliver it to a recipient). The license ends when the photo is deleted from our servers.
  • You’re responsible for having the right to photograph and share what’s in your photos, including other people, and for complying with the law where you are.
  • Don’t use the Service for anything illegal, harassing, sexually explicit involving minors, or that infringes someone else’s rights. We may remove or void passes and suspend accounts that do.

4. Film and free shots

Taking a photo uses one shot of film. Your first shot is free. Additional film comes from purchases (section 5) or referral rewards (section 6). Film has no cash value, is not transferable, and can’t be exchanged for money. Film you earn through referrals stays with your Pookie account; film you buy is tied to your Apple ID and can be restored on your other devices.

5. Purchases and subscriptions

All purchases are made through Apple’s App Store and are subject to Apple’s terms. We don’t process payments or see your payment details. The exact price is shown in the app before you confirm.

  • Film packs are one-time purchases of a fixed number of shots. They don’t expire and don’t renew.
  • Unlimited (monthly) is an auto-renewing subscription that removes the film limit while it’s active. It renews every month at the price shown in the app until you cancel. Payment is charged to your Apple ID at confirmation and again within 24 hours before each renewal. You can cancel any time in iOS Settings › Apple Account › Subscriptions; cancel at least 24 hours before the current period ends to avoid being charged for the next one. Cancelling stops future renewals but doesn’t refund the current period.
  • Refunds are handled by Apple at reportaproblem.apple.com. We can’t issue refunds ourselves.
  • Restore purchases from the film screen if your film or subscription doesn’t show up on a device.
  • We may change prices or the film included in a product. Changes to a subscription price apply only after Apple notifies you and, where required, you agree.

6. Referral rewards

  • You get free film when five people you invite each sign in through your invite link and develop their first photo. The current reward and the number of invites required are shown on the Invite screen and may change for future rewards.
  • An invite only counts when the new user is genuinely new to Pookie, joined through your link before taking a photo, and isn’t you.
  • Creating fake or duplicate accounts, buying or spamming invites, automating sign-ups, or otherwise gaming the program disqualifies the invites involved. We may withhold or remove film earned that way and suspend the accounts involved.
  • We may pause, change or end the referral program at any time.

7. Giving passes away

Give away transfers a photo to someone else: your pass is voided (Wallet shows it as expired) and a fresh pass is issued for the recipient. This can’t be undone. Copies of a pass forwarded outside the app (for example by sharing the pass file) share the same fate as the original when it’s given away.

8. Your account

You can delete your account at any time from the Invite screen in the app, which erases your account data as described in the Privacy Policy. We may suspend or close accounts that break these terms or abuse the Service, and may discontinue the Service with reasonable notice. Purchased film is governed by Apple’s refund policy in those cases.

9. Availability and disclaimers

The Service is provided “as is”. We work to keep it running but don’t promise it will be uninterrupted, that passes will surface at particular times or places, or that photos will be preserved forever — keep your own copies. To the extent permitted by law, we disclaim all warranties and our total liability to you for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim. We aren’t liable for indirect or consequential losses. Nothing here limits rights you have as a consumer that can’t be waived.

10. Apple

The app is licensed, not sold, to you for use on Apple devices you own or control, as permitted by the App Store Terms of Service. These terms are between you and Pookie only, not Apple. Apple has no obligation to provide maintenance or support for the app, isn’t responsible for any product warranty, and isn’t responsible for addressing any claim you or a third party has relating to the app (including product liability, legal or regulatory compliance, consumer protection, or intellectual property infringement). If the app fails to conform to any applicable warranty you may notify Apple, and Apple will refund the purchase price of the app; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Legal compliance

You represent that you’re not in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you’re not on any U.S. government list of prohibited or restricted parties. You must comply with any third-party terms that apply when using the app, including Apple’s.

12. Changes to these terms

We may update these terms. We’ll change the date above and, for material changes, notify you in the app. Continuing to use the Service after a change means you accept it.

13. Governing law and contact

These terms are governed by the laws of the United States, without regard to conflict of law rules, except where the consumer law of your home country gives you more protection.
